US Fish & Wildlife Service Letter to USACOE
Notes adverse impacts to approximately 12.85 acres of wetland, including degraded wetlands, and an area of emergent/sedge meadow remnant in the floodplain of Indian Creek. Alludes to consideration of upland alternative location as required by the Clean Water Act. Objects to wetland mitigation in floodplain, and draws into question possibility of success after excavating 4 feet of present topsoil, even if respread; and considering inundation of floodwaters. Further questions wetlands credits for plan, and questions the need for excavation. Indicates insufficient assurance of replacement of wetland functions or acreage.
Precludes the need for consultation in accordance with section 7 of the Endangered Species Act of 1973, unless more indications are revealed.

This notice contains key information about the location and impacts that this proposed development will cause. It also notes several key weaknesses in the application. The drawings are poor. The applicant proposes to mitigate wetlands in the floodplain, and pay a fee in lieu of a large number of acres to mitigated elsewhere.
